These Terms of Service ("Terms") govern your access to and use of the CyberCaddy website at www.cybercaddy.com.au (the "Site") and any information, tools and content made available through it. By accessing or using the Site, you agree to be bound by these Terms. If you do not agree, please do not use the Site.
The Site is operated by CyberCaddy Pty Ltd ("CyberCaddy", "we", "us", "our"), an independent Australian cyber security firm. You can contact us at enquiries@cybercaddy.com.au or 1/20 Douglas Street, Milton QLD 4064.
You may use the Site for lawful purposes only. You agree not to use the Site in any way that breaches any applicable law, infringes the rights of others, or interferes with the operation, security or integrity of the Site. You must not attempt to gain unauthorised access to any part of the Site, its servers, or any connected systems.
Content on the Site — including articles, guides, assessments and the Essential Eight calculator — is provided for general information purposes only. It does not constitute professional, security, legal or financial advice, and should not be relied upon as a substitute for a formal engagement or tailored advice. Any cyber security services we provide are governed by a separate written engagement agreement, which prevails over these Terms to the extent of any inconsistency in relation to those services.
While we take care to ensure information on the Site is accurate and current, we make no representation or warranty that it is complete, accurate, up to date or fit for any particular purpose. Tools such as self-assessments produce indicative results only and do not guarantee any security outcome or compliance status.
All content on the Site, including text, graphics, logos, the CyberCaddy name and brand, and their arrangement, is owned by or licensed to CyberCaddy and is protected by Australian and international intellectual property laws. You may view and print content for your own internal, non-commercial use. You must not otherwise copy, reproduce, republish, distribute or create derivative works from the Site without our prior written consent.
The Site may contain links to third-party websites or resources. We provide these links for convenience only and do not endorse and are not responsible for the content, products or practices of any third-party site. Accessing third-party sites is at your own risk and subject to their terms.
To the maximum extent permitted by law, the Site and its content are provided "as is" and "as available", and we exclude all warranties, express or implied. To the maximum extent permitted by law, CyberCaddy will not be liable for any indirect, incidental, special or consequential loss, or any loss of profits, data or goodwill, arising out of or in connection with your use of the Site.
Nothing in these Terms excludes, restricts or modifies any guarantee, right or remedy you may have under the Australian Consumer Law or any other law that cannot lawfully be excluded. Where our liability for a failure to comply with a non-excludable guarantee can be limited, our liability is limited, at our option, to re-supplying the relevant services or paying the cost of having them re-supplied.
You agree to indemnify CyberCaddy against any loss, damage, cost or expense we reasonably incur arising from your breach of these Terms or your misuse of the Site, except to the extent such loss is caused by our own negligence or breach.
Our handling of personal information is described in our Privacy Policy, which forms part of these Terms. Please review it to understand how we collect, use and protect your information.
These Terms are governed by the laws of Queensland, Australia. You submit to the non-exclusive jurisdiction of the courts of Queensland and the Commonwealth of Australia.
We may update these Terms from time to time. The current version will always be available on the Site, with the "Last updated" date shown at the top. Your continued use of the Site after changes take effect constitutes acceptance of the updated Terms.
If you have any questions about these Terms, contact us at enquiries@cybercaddy.com.au.
